If you do not agree to the terms of this Privacy Notice, please do not use the Site. PGR Creations has developed a relationship with our clients based on respect and integrity. We are aware of the trust and confidence you place on us when you visit the Site and provide us with information. This Privacy Notice is posted to demonstrate our leadership in online security and customer service practices. We treat your information with the honesty and sensitivity you would expect from PGR Creations.
PGRCREATIONS.COM uses information that we collect from our visitors and clients so we can serve them appropriately. We gather the following types of information:
Information You Give to Us
We Collect Personal Information that is provided by Site users. "Personal Information" may include your name, address, telephone number, e-mail address, and IP address. Personal Information is collected when you establish an account with us, place an order on the Site, or when you communicate with any of our departments such as customer service, sales or technical services through the Site, telephone or mail.
If you place an order through the Site, you will be required to provide contact, billing, and payment information.
Email Newsletter Subscriptions
Upon hiring PGR CREATIONS for work on your site, you will be automatically added to PGR CREATIONS' newsletter mailing list, unless you opt-out of receiving such communications. We use a confirmation process that allows you to unsubscribe if you decide you no longer wish to be a member of the list. Furthermore, the confirmation email will alert you if someone else has entered your email address into our email newsletter subscription list. In order to make our email newsletters more relevant and useful to you, our servers may receive a confirmation when you open an email message from PGRCREATIONS.COM.
We use this information in an effort to provide services for you and to communicate with you about information that you request.
Credit Card Companies
If you make an online payment through the Site, the Personal Information you provide to us is transmitted to a credit card company to verify and authorize your payment. Information such as your credit (or debit) card or bank account number, CVV, and expiration date is handled directly by PayPal, our third party credit card processor, and is not shared with nor retained by PGR CREATIONS. Only your name, address, phone number, email address and amount of the transaction is shared with PGR CREATIONS.
The Site is a general audience website and is deemed not harmful or containing information inappropriate for children under the age of 13. We will never knowingly collect personally identifiable information from children under the age of 13 without verifiable parental consent. If you are under the age of 13, please do not provide us with personally identifiable information of any kind. If we become aware that a user is under the age of 13 and has submitted Personal Information without verifiable parental consent, we will remove his or her personally identifiable information from our files. We understand that children may not fully understand all of the provisions of this Privacy Notice or make informed decisions about the choices that are made available to adult users of the Site. We encourage parents and guardians to spend time with their children online and to be familiar with the websites they visit. PGRCREATIONS.COM does not knowingly sell products to persons under the age of 18. If you are under the age of 18, you are required seek the consent of your parent or guardian to purchase products from the Site.
A retainer in the amount of approximately 30% of the projected cost of the project is typically requested to secure the services of PGR Creations and for account set up. At the completion of the project and launch of the web site, the retainer is applied to the cost of the project and the remaining balance is due. If you choose to terminate your project prior to project completion, the retainer is fully refundable within two weeks of acceptance of the proposal. One‐half (50%) of the retainer is refundable within one month. After one month, the retainer is not refundable.
In the course of developing a web site for you, the purchase and installation of third party software or other aids may be necessary to provide certain functionality for the site. Such software or aid will remain the property of PGR Creations and the cost for such software or aid may be deducted from your refund at PGR Creations' discretion.
If PGR Creations is unable to deliver a completed and fully functional product as promised due to illness, incapacity, or inability, the retainer and any milestone payments provided will be fully refundable. For other situations that are not the fault of PGR Creations, depending on the cause, the retainer may or may not be refundable in whole or in part at PGR Creations' discretion.
Your satisfaction is our priority. We want you to be satisfied with your web site. After receiving your approval of the web design draft, we begin building your web site. If, however, during the development you change your mind and wish to have a different design, we will charge you for the amount of work completed. A new work order and fee structure will then be created for the new design.
If your web site is defective (that is, it does not perform according to specifications) and PGR Creations is unable to fix the problem to your satisfaction, we will either contract with a third-party at our expense to make the necessary revisions, or reimburse you (or credit your account) for the defective portion.
PGR Creations creates digital web products. These products are not typically shipped. However, if a client has provided material for a project that has to be returned, PGR Creations will pay for the return shipment.
PGR Creations typically provides up to 3 months site maintenance following launch of the web site at no cost to our clients. Site maintenance is defined as revising, repairing existing web pages, and assisting with the maintenance of databases, if they exist. Site maintenance pertains to existing pages and therefore does not include the creation of new web pages.
After the free maintenance period, you may elect to maintain your own web site, sign up for a monthly maintenance plan through PGR Creations, or request changes on an "as-needed" basis. PGR Creations will offer a maintenance plan based on the initial 3 month experience.
PGR Creations sends electronic or mailed invoices at the beginning of each month. Discounts are available to clients wishing to take advantage of electronic forms of billing and/or who pay annual fees for hosting, maintenance, etc. Clients typically have until the 25th of the month to pay their bill. Payment may be mailed to PGR Creations, 4884 Krestridge Court East, Bargersville, Indiana 46106 or paid online.
PGR Creations accepts payments via the following methods:
We will send you a billing statement at the beginning of each month that your Account has a balance due. Your billing statement will show the amount you owe us and the due date. The due date is typically the 25th of the billing month. It is expected you will pay your bill in full by the due date unless prior arrangements have been made.
If you as an existing or potential client of PGR Creations LLC are offered a period of time 'same as cash' as a payment plan for services to be rendered and you accept the offer that means you agree to the following:
After a 30-day grace period, a monthly periodic finance charge of 1.25%, minimum $5.00, may be added to the outstanding balance of your account if you are late with your payment or maintain an outstanding balance without prior arrangement with PGR Creations.
Non-payment of fees can result in your website being placed in a state of "Suspension" if payment is not made within three (3) months. Website suspension means your website will not display; instead visitors to your site will see a message explaining that the site has been suspended. It is possible email associated with your domain might also be affected as a result of suspension.
If no payment is received within six (6) months, your website could be subject to termination and removal from the web server. PGR Creations will not release the website until all outstanding fees have been paid.
PGR Creations assumes no responsibility and shall not be liable for any loss or damage incurred as a result of your website and/or email suspension or termination due to your non-payment of our fees.
Returned Check Fees
If your payment is returned unpaid by your bank (also known as "bouncing a check"), your returned check fee will be $35. It will be $45 if your bank returns another payment from you in the following 6 billing periods.
If you think your bill is wrong, or if you need more information about a charge on your bill, email or call PGR Creations at 317-409-9323. You do not have to pay any amount in question while we investigate your concern. However, you are still obligated to pay the portion of your bill that is not in question.
As a client of PGR Creations, LLC, and by your use of the services of PGR Creations, LLC, you understand and agree to be bound by the terms described in this document and that you will be liable for payment of all amounts owed on your account. Subject to applicable law, you will be in default under this Agreement if you violate any term of this Agreement, fail to make the Payment Due by the Payment Due Date, or become the subject of bankruptcy or insolvency proceedings. Upon default or death, subject to applicable law, we may, in our sole discretion: (a) Terminate your account and all related services at which time the terms of this Agreement will continue until we have been paid in full; (b) require immediate payment of the total balance on your Account including all related fees and charges described in this Agreement; (c) bring a legal action against you to collect money owed to us; (d) take any other action permitted by applicable law. If we refer your Account to an attorney for collection, you must pay to us all costs and expenses of collection, including attorneys' fees and court costs, to the extent not prohibited by law.
